This was really good news for me because one of my friends (who currently lives in tennesee 'cause that's where his bf is) wants to get married this summer and they were going to go all the way up to Canada. Now they can just come here and stay with us for a bit and maybe they'll change minds about having my great Uncle give services (as a holy man he's Pastor Pork of the Church of the Everlasting Hawg). He recently did my sister's wedding and that was great fun.
Also, it is of note that our Gov. stated that he supports the court ruling and would rally against a constitutional amendment banning gay marriage. As a member of the GOP, a party which constantly panders to the christo-fascists, that's a very brave stance for him to take. |

It takes time but the world can change one person at a time and eventually it's a better place for everyone.
So the fundies are going to make a consitutional amendment to outlaw gay marriage (basically they have to make an amendment which makes it OK for bigotry through laws). The good news is those of us who want social justice can also make an amendment that states that bigotry is not allowed. I'm researching the process right now although I'm certain someone who is both smarter and richer than I will start it first. |

| I really think the more states individually start allowing gay marriage, the harder it will be for a constitutional amendment to pass banning it. I also think that any such amendment would itself be unconstitutional, as it would violate separation of church and state as well as the spirit of the constitution itself-- which is to ensure the rights of the people, not restrict them. Prohibition didn't work, and neither will a constitutional amendment banning gay marriage if, heaven forbid, such a thing even manages to pass. |

Well, the Federal Amendment would be anti-constitutional in that marriages are not documented by the Federal government and are actually performed by the States themselves. This is why we had inter-racial marriage legal in the state of California 60 years ago, but laws existed banning inter-racial marriage in Virginia and some other states as recently as 35 years ago!
So right now what the fundies are proposing is an amendment to the State Constitution rather than the Federal Constitution. That way it doesn't have to go through congress/senate and instead it requires 1.3 million signatures (in a state with so many people it shouldn't be hard to find that many bigots) then it will be put on the ballot in november for everyone to vote on.
Even if the Supreme Court of the US decides that the anti-gay marriage law is against the constitution of the United States (which they should because it does, but they may not because right now they're controlled by GOP lapdogs) the amendment of the California Constitution could be slapped on and the only way to defeat that is with another amendment to the State's Constitution. It should be noted that there's very little chance that this amendment would pass through the general election since california has always voted democratic in general elections and Arnold is going to be standing against it which should assuade some GOP members from their bigoted views...
Still, if there is an amendment which says "same sex marriage is banned" the only way to counter-act that is with an amendment which says "with regards to marriage or anything else, the california constitution cannot be bigoted". By the way, that's what the judgement was based on, they believed that the law against same-sex marriage treated a certain portion of the citizenry of california like second-class citizens and was at its heart, bigoted. The constitution has a clause against laws which are made to punish a specific portion of the citizens.
Our government is way too odd, this is just as far as i know, someone else may know more than the bit i've picked up from being on GP for a few years. |
